Real estate
Drafting of sale, purchase and lease agreements, transaction due diligence.
Poland has a booming real estate market. If you are planning on conducting any kind of transaction concerning real estate, be it purchase, sale, rent, or mortgage, be sure to consult a lawyer beforehand.
Why is that?
First of all, Poland imposes additional formalities on foreigners who wish to purchase any kind of real property. Make sure that you meet these formalities before making any binding commitments.
Secondly, the sale and purchase of real estate is regulated by very detailed legal provisions that, if breached, may even cause a transaction to be completely invalid. When purchasing properties it is also important to conduct due diligence to determine the complete factual and legal state of the property (for example, its status is the local development plan).
Finally, when leasing a property it is important to have a well-written contract in place to protect yourself against potential future conflicts with the other contractual party.
